Kratomic is the trading name and brand under which MAYA WORLD TRADING B.V. offers its products.

2. Applicability

These Terms & Conditions apply to every offer made by Kratomic and to every agreement concluded between Kratomic and the customer through this webshop.

By visiting our website, placing an order, or purchasing products from us, you agree to be bound by these Terms & Conditions, as well as any policies referred to on this website, including our Privacy Policy and Shipping Policy where applicable.

If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

3. Products and Intended Compliance

Kratomic offers botanical and ethnobotanical products through its webshop. Product information on this website is provided in good faith and is intended for general informational purposes only.

Customers are responsible for informing themselves properly about the products they purchase, including their characteristics, manner of use, and any restrictions that may apply in their country, region, or locality.

Kratomic does not accept any responsibility for unlawful, improper, unsafe, unintended, or negligent use of any product purchased through this webshop.

4. Legal Responsibility and Local Laws

We do our best to ship only to countries where kratom may legally be sold to the best of our knowledge. However, laws and regulations may vary between countries, regions, states, provinces, or municipalities, and they may change over time without notice.

For that reason, it remains the customer’s sole responsibility to verify whether ordering, importing, receiving, possessing, selling, or using the products offered by Kratomic is lawful in the jurisdiction that applies to them.

By placing an order, the customer confirms that they have made this assessment themselves and that they assume full responsibility for compliance with all applicable laws and regulations.

Kratomic cannot accept responsibility or liability for products that are ordered, imported, received, possessed, sold, or used in violation of local laws. Kratomic shall not be liable for customs seizures, import refusals, destruction of goods, delays, returns, confiscations, penalties, or any other consequences arising from local laws, customs procedures, or enforcement actions.

Kratomic reserves the right to refuse, suspend, or cancel any order where there is reason to believe that shipment, receipt, possession, or use of the products may be unlawful.

5. Age Requirement

By placing an order on this website, you confirm that you are at least the age of majority in your country or jurisdiction and legally entitled to purchase the products concerned.

Kratomic reserves the right to refuse or cancel orders if there is reason to believe the customer does not meet the applicable age requirement.

6. The Offer

We aim to describe and present our products as accurately and clearly as possible. However, obvious errors, mistakes, typographical errors, pricing errors, and manifest inaccuracies in product descriptions, stock information, or other website content are not binding on Kratomic.

Images are intended for illustrative purposes only. Minor differences in packaging, colour, appearance, weight, or presentation do not constitute grounds for complaint, provided the delivered product is materially in line with the order.

All offers are subject to availability.

7. Formation of the Agreement

An agreement is formed when the customer places an order and Kratomic confirms acceptance of that order by email or otherwise begins processing it.

Kratomic reserves the right to refuse or cancel an order at any time before dispatch, including in cases of incorrect pricing or website errors, suspected fraud or abuse, unavailable stock, legal or compliance concerns, or doubts regarding the lawfulness of shipment to the destination.

If payment has already been made for an order that is cancelled by Kratomic before dispatch, the amount paid will be refunded as soon as reasonably possible.

8. Prices and Payment

All prices shown on the website are inclusive of VAT unless stated otherwise.

Shipping costs, if applicable, are shown separately during checkout before the order is completed.

Kratomic reserves the right to change prices at any time. Price changes do not affect orders already accepted.

Orders must be paid using one of the payment methods offered during checkout. Kratomic may withhold shipment until full payment has been received.

9. Delivery and Shipping

Kratomic ships from the Netherlands.

We aim to process and dispatch orders promptly. Delivery times shown on the website or communicated by us are estimates only and are not guaranteed deadlines, unless explicitly agreed otherwise in writing.

Kratomic is not liable for delays caused by carriers, customs authorities, force majeure, local import procedures, incorrect address details supplied by the customer, or circumstances outside our reasonable control.

The customer is responsible for providing a complete and accurate delivery address. Additional costs resulting from incorrect or incomplete address information may be charged to the customer.

The risk of loss of or damage to products passes to the customer at the moment of delivery, unless mandatory law provides otherwise.

10. Right of Withdrawal and Returns

If the customer is a consumer within the meaning of applicable consumer law, they may have the right to withdraw from the purchase within 14 days of receiving the goods, without giving reasons, unless a legal exception applies.

To exercise this right, the customer must notify Kratomic within the applicable withdrawal period by a clear statement sent by email or other written means.

After notifying withdrawal, the customer must return the products without undue delay and no later than 14 days after that notification, unless applicable law provides otherwise. Returned items should be sent back in their original condition and, where reasonably possible, in the original packaging.

The direct costs of return shipment are borne by the customer unless mandatory law requires otherwise.

Kratomic may reduce the refund if the returned product has diminished in value due to handling beyond what is necessary to inspect its nature, characteristics, and functioning.

Refunds will be made using the original payment method unless another method is agreed. Where the legal right of withdrawal applies, refunds may be withheld until the goods have been received back or proof of return has been provided.

11. Exclusions from Return or Withdrawal

The right of withdrawal may be excluded or limited where this is permitted by applicable law, including for example where products are sealed and are not suitable for return for reasons of health protection or hygiene once unsealed.

If Kratomic applies any such exclusion to a specific product category, this will be stated clearly on the website or at checkout where required.

12. Inspection, Complaints, and Conformity

The customer must inspect the products upon delivery and report any visible defects, delivery errors, or missing items within a reasonable time after receipt.

Complaints concerning an order should be submitted as soon as possible and include a clear description of the issue, together with the order number and, where relevant, photographs.

Kratomic will handle complaints within a reasonable time and aims to provide a substantive response within 14 days of receipt.

Nothing in these Terms & Conditions limits any mandatory statutory rights a consumer may have under applicable law regarding defective or non-conforming goods.

13. Refusal of Liability for Illegal or Improper Use

All products sold by Kratomic are offered on the condition that they will be handled, possessed, imported, and used only in full compliance with all applicable laws.

Kratomic expressly disclaims liability for illegal use of products, misuse, abuse, or reckless use, use contrary to local laws, regulations, or customs rules, consequences resulting from self-medication, unsafe combinations, or irresponsible handling, and any indirect or consequential loss arising from unlawful or improper use of the products.

The customer agrees that any use of products purchased from Kratomic is at their own risk and under their own responsibility.

14. Limitation of Liability

To the fullest extent permitted by law, Kratomic’s liability shall be limited to the value of the relevant order or, where applicable, the amount actually paid by the customer for the product giving rise to the claim.

Kratomic shall not be liable for indirect, incidental, punitive, or consequential damages, including loss of profit, loss of opportunity, reputational damage, or third-party claims, except where such limitation is not permitted under mandatory law.

Nothing in these Terms & Conditions excludes or limits liability where such exclusion or limitation would be unlawful.

15. Force Majeure

Kratomic shall not be liable for any failure or delay in performance resulting from circumstances beyond its reasonable control, including but not limited to transport disruptions, customs delays, strikes, pandemics, natural events, war, governmental measures, cyber incidents, supplier failures, or interruptions in payment or logistics services.

In such cases, Kratomic may suspend performance or cancel the agreement in whole or in part without being liable for damages.

16. Intellectual Property

All content on this website, including text, logos, branding, images, product descriptions, graphics, and design elements, is the property of Kratomic and/or its licensors unless stated otherwise.

No part of this website may be copied, reproduced, distributed, or used commercially without prior written permission.

17. Privacy

Kratomic processes personal data in accordance with its Privacy Policy. Customers are encouraged to read that policy to understand how their data is collected, used, and protected.

18. Applicable Law and Disputes

These Terms & Conditions and all agreements between Kratomic and the customer are governed by Dutch law, unless mandatory consumer law in the customer’s country of residence provides otherwise.

Any disputes shall be submitted to the competent court in the Netherlands, unless mandatory law requires another competent forum.
